Pilot triumphs in divorce appeal

Times Online reports on a Brookman divorce case where a new precedent is set relating to how pension values are considered.
Former British Airways pilot, Phillip Martin-Dye, won his appeal ruling that his pension worth £900,000 should not be considered an ordinary asset in his divorce.
Mr Martin-Dye had appealed over whether his pension should be treated as an asset when dividing up the marital wealth. Prior to the appeal, the pension was included as a capital asset, being divided between the couple based on its total estimated value. However, a successful appeal resulted in Mr Martin-Dyes settlement being amended by £650,000 in his favour. Henry Brookman, Mr Martin-Dyes solicitor, said the case set a precedent that the courts can no longer equate pension values with other capital assets.
