A former Miss Malaysia, Pauline Cha, who currently lives in Hertfordshire is seeking to divorce her husband under English law.  It is reported that if successful, the divorce pay-out could be Britain’s biggest at £500 million.

The estranged husband Khoo Kay Peng, one of Malaysia’s wealthiest businessmen wants the hearing to be in Malaysia, the Times has reported.  The assumption being that the former Miss Malaysia and wife of 42 years could receive a lesser pay-out.

Henry Brookman takes the view that an individual should be allowed to choose where they divorce if the law allows it, commenting “the husband accuses Pauline Cha of “blatant forum shopping”, as if that was a reprehensible matter, but why shouldn’t she apply for divorce in London?  They are an international family who lived around the world and had a home base in England as well as in Malaysia.  Why should this lady be saddled with Malaysian law?”

“English divorce law says that there has to be a “just and equitable” result.  That does not necessarily mean an equal result, but it absolutely does mean a just result.  The meaning of justice can vary according to your cultural starting points, but that is no reason for the English courts to somehow feel they have something to apologise for.”
