When going through a difficult divorce, added worries or concerns are the last thing you need. Unfortunately, particularly for complex or contentious divorces, solicitors’ fees can add up, and divorcees’ fears stem to their finances.
But for those who are not financially able to pay for the solicitor guidance that they need, there are alternative options to paying for your divorce. One of these is known as a Sears Tooth Agreement.
A Sears Tooth Agreement is an agreement between solicitor and client that ensures the solicitor is paid for their guidance and actions throughout the divorce without causing financial fears for the client. The solicitor and their client agree that an appropriate amount of the client’s final divorce settlement is provided to the solicitor to meet the fees.
Once this agreement is agreed and signed, it is disclosed to the Court and becomes a legally binding contract. A Sears Tooth Agreement is only an option in situations where a good settlement is expected; in cases where there are minimal finances and the client is not looking for a large pay off, it would not be suitable.
Depending on the individual’s situation, financial obligations vary. For example, those earning under a certain amount may be entitled to free legal guidance, to work out the most suitable one for you, it is advisable to discuss your financial and divorce situation with a solicitor.
