The Czech Republic law on divorce is very consistent with other continental European countries. There is a civil code which sets out the rules for divorce, financial arrangements and decisions on children matters. Matters proceed step by step in front of a judicial hierarchy. The process can sometimes be frustrating in that it is taken in a very orderly, ‘one step at a time’ process rather than a Judge taking full case management control. All three aspects are concluded with the divorce itself.
Like other European Union countries, the sole criteria for residence and custody of children is what is in the best interest of the child. Likewise, the Czech Republic is party to the treaty arrangements relating to child abduction ensuring consistent rules across Europe and pursuant to the Hague Convention on the International Aspects of Child Abduction, in many other countries across the world.
