Ukraine is a civil law jurisdiction. The Family Code determines the principles of marriage, financial arrangements within marriage and upon divorce, and obligations in relation to children.
Ukraine is a party to the Convention on the rights of the child and subsequently acceded to the Convention on the Civil Aspects of International Child Abduction. The Family Code broadly speaking creates a common joint property regime, but prenuptial agreements are valid and enforceable, and are very common. The formalities are minimal, there is no obligation for a full disclosure of financial status, and no obligation to show that either side has taken legal advice. Nevertheless there is no evidence to indicate that this is seen as unsatisfactory.
The law provides for spousal maintenance, although only in certain cases such as disability or responsibility for very young children.
There is a domestic procedure for enforcement of foreign orders but it is not straightforward.
There is provision for cohabitants, but same sex marriage is not accepted.
